Mediation
Mediation is a relatively new legal field in Sweden, at least regarding corporate legal proceedings. Through Västsvenska Industri- och Handelskammaren's (West Sweden Chamber of Commerce and Industry) agreement with CEDR, Nordic Law has been given an opportunity to accredit our lawyers as mediatiors according to the CEDR model. The increasingly sought after mediation service is aimed at helping two or more conflicting parties to come to an agreement about their dispute on business-like terms, specially when the dispute is either complex or where the battle-lines haven't been fully established.
Mediation has plenty of upsides compared to legal proceedings through civil courts or through arbitration:
- Agreement from mediation is built on the voluntary efforts of all parties
- Short period of time from the definition of a dispute to the (possible) solution through agreement
- Limited transaction costs and limited risks
- Maintenance and potential possibilities to develop further business relationships
- Business-oriented solutions can be sought, regardless of fault and responsibility
- The parties own control over the proceedings
- Countless numbers of parties can participate
- Mediation can be interrupted whenever a party calls for it
- Confidentiality can be agreed upon when parties wish for.
